Terms of Service – Avenew Group

These Terms of Service (“Terms”) govern your access to and use of websites, services, and offerings provided by Avenew Group (“Avenew”, “we”, “our”, or “us”), including PT Avenew Akademi Inovasi, PT Avenew Indonesia, and Yayasan Avenew Inspirasi Indonesia.
By accessing our website or engaging with our services, you agree to be bound by these Terms.
Scope of Services
Avenew provides consulting, training, mentoring, and capability development services in the area of project management and organizational transformation. These services may be delivered in various formats, including public training programs, in-house corporate training, advisory engagements, workshops, digital learning platforms, and research-based initiatives.
The scope, deliverables, and terms of each service may vary and are typically defined in separate agreements, proposals, or program-specific terms. In the absence of such agreements, these Terms shall apply.
Use of Website and Platforms
You agree to use Avenew’s websites, platforms, and digital services only for lawful purposes. You must not misuse, disrupt, or attempt to gain unauthorized access to any part of our systems, platforms, or data.
Where access to digital platforms, accounts, or paid content is provided, you are responsible for maintaining the confidentiality of your access credentials and for all activities conducted under your account.
Intellectual Property and Usage Rights
All materials, content, frameworks, methodologies, training modules, designs, research, publications, and digital assets provided by Avenew are the exclusive intellectual property of Avenew unless otherwise stated.
This includes proprietary frameworks, capability models, training content, and any supporting materials developed or delivered by Avenew.
For training and consulting engagements, Avenew grants a limited, non-transferable, and non-exclusive right to use materials strictly for internal and non-commercial purposes within your organization. This applies only to materials explicitly shared as part of the engagement.
You are not permitted to reproduce, distribute, modify, publish, sublicense, or commercially exploit any Avenew materials without prior written consent.
Any unauthorized use, replication, or distribution of Avenew’s intellectual property constitutes a violation of these Terms and may result in legal action.
Training Materials and Content Access
Participants in training programs may receive access to materials such as slides, toolkits, or recordings where applicable. Such materials are provided solely for learning and internal reference purposes.
Certain materials, including but not limited to third-party licensed content, official certification materials, or proprietary Avenew frameworks, may not be shared, redistributed, or reused beyond the permitted scope.
Access to digital learning platforms or content may be time-limited and subject to specific access conditions.
Consulting Services Disclaimer
Avenew provides consulting and advisory services based on professional expertise, research, and established methodologies. However, outcomes depend on multiple external factors, including organizational context, execution capability, stakeholder alignment, and implementation discipline.
Avenew does not guarantee specific business results, performance improvements, or measurable outcomes. Clients acknowledge that Avenew’s role is to support capability development and advisory processes, and that ultimate results depend on client-side execution.
Client Responsibilities
Clients and users agree to provide accurate and complete information and to engage in good faith throughout the service engagement. Clients are responsible for internal implementation, decision-making, and the application of any recommendations or materials provided by Avenew.
Clients must not misuse or distribute Avenew materials beyond agreed usage rights.
Payment, Cancellation, and Rescheduling
Fees for Avenew services are communicated through official proposals, invoices, or program registration details.
All payments made for training programs and services are generally non-refundable. In certain cases, at Avenew’s discretion, payments may be transferred or credited toward other programs or services.
Avenew does not maintain a fixed cancellation or rescheduling policy for all services. Requests for rescheduling or adjustments, particularly for corporate engagements, may be considered on a case-by-case basis depending on availability and operational considerations.
For multi-phase or ongoing engagements, services may be delivered partially over time. Payment obligations remain applicable based on agreed terms regardless of delivery structure.
Limitation of Liability
To the fullest extent permitted by applicable law, Avenew shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, materials, or website.
This includes, but is not limited to, loss of business, loss of revenue, loss of data, or failure to achieve expected outcomes from training or consulting services.
Confidentiality
Both Avenew and its clients agree to maintain the confidentiality of any sensitive or proprietary information shared during the course of engagements, unless disclosure is required by law or explicitly authorized.
Third-Party Services
Avenew may utilize third-party platforms or tools to deliver certain aspects of its services. Avenew is not responsible for the policies or practices of such third parties.
Termination of Access
Avenew reserves the right to suspend or terminate access to its website, services, or platforms if users violate these Terms or engage in conduct that may harm Avenew’s business or reputation.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.
Changes to Terms
Avenew may update these Terms from time to time. Updated versions will be posted with a revised effective date. Continued use of services constitutes acceptance of any changes.
